Terms and conditions
This website is edited and managed by the company L’Atelier d’Amaya, a company with a capital of 30,000 € headquarters located at 44-50 BD GEORGE V 33077 BORDEAUX CEDEX (France), and registered to the RCS of Bordeaux (France) under the SIREN number 529 549 180.
The general conditions described hereafter define the rights and obligations of L’Atelier d’Amaya and of the buyer, mentioned as client, who are classed as follows:
Clients are considered as buyers who are acting exclusively as private persons, not business persons. The client declares that they have the legal capacity to conclude the present contract, to have the legal majority and not to be under guardianship according to the article 1146 of the Code Civil.
ARTICLE 1: CONTRACT CREATION
The contract creation between L’Atelier d’Amaya and the client occurs when the order is confirmed. The order confirmation sums up the purchase details and acts as a contract between the client, L’Atelier d’Amaya and the website www.atelier-damaya.com.
All of the products referenced on the website www.latelier-damaya.com are available for delivery in all countries covered by La Poste.
ARTICLE 2: ORDER TERMS AND CONDITIONS
1. Online sale
The website www.latelier-damaya.com allows the client to order from L’Atelier d’Amaya a selection of products from the brand L’Atelier d’Amaya immediately online for a delivery in any of the countries covered by La Poste. The order process is the following: the client can add a product to their cart at any time by clicking on “Add an item”. The product is then added to their cart and the client can continue viewing the website and adding other products. The client can display the content of their cart, prices and product details by clicking “My cart”. The client can finalize their order by clicking on “Pay for my order”.
For an order to entirely validated, the client must identify themselves by filling in their first name, last name and private email address.
To finalize their order, the client must accept the general terms and conditions and the confidentiality agreement by ticking the box provided. The client must give their billing and shipping address, chose the delivery option, select the payment method and then validate the order. The order is confirmed once all the above conditions have been met.
To avoid any mistakes, L’Atelier d’Amaya advises the client to carefully check and verify the content of their entire order (product, price, options) before confirming it. The client will be able to verify the information again using the confirmation email that validates the order. The client will have access to the exact details of their order in their personal customer account,accessed by clicking the tab “History and order details”.
L’Atelier d’Amaya reserves the right to refuse, cancel or terminate contracts at any time for legitimate reasons. For example, in case of litigation regarding the payment of a previous order or if L’Atelier d’Amaya suspects any violation to the general terms and conditions or attempted fraud.
2. Phone sales
The client can also order by phone on +33 (0)5 56 81 57 71 from Monday to Saturday (except bank holidays) from 10am to 6:30pm (GMT+1). The list of products L’Atelier d’Amaya offer for sale is accessible on the website www.latelier-damaya.com. To place a specific order, or for queries about your phone order please contact L’Atelier d’Amaya directly.
ARTICLE 3: PRODUCT
Every order placed on the website or by phone is subject to availability and will be shipped accordingly.
L’Atelier d’Amaya makes every possible effort to ensure that products listed on the website are available for order. For technical reasons, some products might not be available once the order is being confirmed. In such cases, the client will be contacted directly by our customer service team to find the most suitable solution.
Each product’s distinctive features are displayed on our website under the tab “More details”. Pictures of items on the website may vary from the final product. Photography being an optical and technical process, there may be some small variations in appearance.
To make sure you chose your product in the right size, we advise all of our customers to carefully consult the section of our website on sizing.
ARTICLE 4: GIFT CARD L’ATELIER D’AMAYA
Gift cards from L’Atelier d’Amaya cannot be exchanged or refunded. Products bought using the gift card L’Atelier d’Amaya are subject to the same guarantee policy as products acquired with other payment methods.
The gift card L’Atelier d’Amaya can be used multiple times until the credit has run out. If the price of an order is superior to the gift card amount, the difference can be paid using the other payment methods offered by the website.
At any time and without notice, L’Atelier d’Amaya reserves the right to modify the gift card general terms and conditions and will inform the customers of any such changes via the website.
When purchasing a gift card, the client will receive a code that is valid for 1 year.
In order to use the gift card for a purchase, the client must type the code into the specified space in the cart. Once the code has been validated, the amount due will be automatically updated accordingly.
In the case of the code not working, please contact our customer service team for further assistance.
ARTICLE 5: PRICES
Prices indicated on the website are displayed in Euros (€) all taxes included (TTC) based on French value added tax (VAT=20%) excluding transportation costs.
L’Atelier d’Amaya reserves the right to change prices without notice.
The total amount due by the client is the amount indicated at the point at which the order is confirmed.
The total amount of the cart at step 1 is given on an indicative basis, with a preselected delivery method.
The total price will be notified in step 4 “Delivery option”.
Step 5 “Payment” allows the client to choose his payment method. The amount displayed is the total amount including transportation fees.
Once you have received the order confirmation, an invoice will be available in your personal account on the website. The invoice will summarize the different items purchased and the total amount paid and debited.
ARTICLE 6: PAYMENT
Any item purchased on the website www.atelier-amaya.com can be paid for using a debit card, PayPal or a cheque. In the case of a payment by cheque, the order will be dispatched once the cheque has been received and successfully cashed.
In the case of a payment by debit card, the amount is debited when the order is confirmed and after the transaction has been approved by the bank issuing the card.
In compliance with the CNIL, payments are secured to protect sensitive data: card numbers, expiration date, visual cryptogram (PCI DSS). This platform encrypts and transmits payment data to the bank, ensuring confidentiality and inaccessibility to any third party.
In the case of a bank refusal, the order will be automatically cancelled. Your debit card number will not be communicated to L’Atelier d’Amaya at any time.
For phone sales, no debit card data given by the client is stored by L’Atelier d’Amaya.
ARTICLE 7: DELIVERY AND DISPATCH
L’Atelier d’Amaya delivers the item(s) purchased to the address indicated by the client during step 3 “Delivery address”. The client must verify that the address is correct. Any re-delivery due to an inexact address will be charged to the client.
Delivery fees are calculated according to the delivery method chosen by the client during step 4 “Delivery”.
Every order is processed by L’Atelier d’Amaya within 1 to 2 working days. The client will receive an email when the order is dispatched, including a tracking number allowing the client to locate the parcel via the transporter’s website.
Delivery schedules mentioned on the website are given on an indicative basis. In metropolitan France, delivery time cannot exceed 15 days from the reception of the order’s confirmation. The average delivery time is between 1 and 5 working days. However, L’Atelier d’Amaya cannot be held responsible for any delay that arises due to the transporter company.
The client can choose to pick up the parcel in store during step 4 “Delivery”. This service is free. The client can pick up the parcel during store opening hours within 6 months. Beyond this time, the order will be automatically cancelled between the two parties.
If the return is due to an error made by L’Atelier d’Amaya (reference, size, hidden defect…), L’Atelier d’Amaya commits to refunding the postage fees and covering the costs for sending a new item. The client can also ask for a total refund for the item(s) and postage fees.
Subject to agreement with L’Atelier d’Amaya, the client can choose between an exchange and a refund. The exchange can be with the same item or a different one. If there is a price difference between the 2 items, the client can either pay the difference or get a gift voucher.
Any returned item must be unworn and in its original packaging. If the return does not meet those conditions, the item will be returned to the client at his expense.
L’Atelier d’Amaya will not refund or exchange any engraved or customized piece of jewellery.

ARTICLE 8 : RETRACTATION RIGHT
According to article L.121-21, L.121-21-1, L.121-21-2 of the consumption code, an unsatisfied customer has 14 days after the reception of his order to make a retraction. At L’Atelier d’Amaya we extended this delay to 30 days. The customer doesn’t have to supply a specific reason to use his retraction right.
In order to make a return, the customer has to fill the return form, transmitted after getting in touch with the customer service by email at [email protected] or by phone +33 (0) 5 56 81 57 71. This form must be filled with the customer’s first name, last name, address, order number, the product list and a few lines of explanation about the return.
This form must be sent in the package the customer will send back with the products. If the customer wants to return several products from the same order, all the products must be sent together
Return fees are at the customer’s charge.
Each returned product must be intact, without wear marks and inside its original packaging.
If the returned product is damaged, it will be sent back to the customer at his own expense.
L’Atelier d’Amaya will not refund or exchange engraved or personalized jewels according to article L121-20-2 of the consumption code which allowed e-sellers to exclude from the retraction right «product (…) obviously personnalized »
Customer can choose between a refund and a credit note. In case of telephone orders, the refund can only be made by check.
The Customer will be refunded with the amount of the order concerning the returned product as well as the initial delivery costs, i.e. the standard delivery (Tracking letter at 5 euros) in accordance with the Hamon law in force since June 2014 "The professional is not obliged to reimburse the additional costs if the consumer has expressly chosen a delivery method more expensive than the standard delivery method proposed by the professional", at the latest 14 days after the exercise of the right of retraction.
For your information, products bought online are not refundable in our shops.
ARTICLE 9: RETURNED PRODUCTS
To return a product, the customer has to contact L’Atelier d’Amaya first in order to report the return reason. After an agreement between both parts, the customer has to send the product back to L’Atelier d’Amaya at his own expense.
If the return is due to a mistake made by L’Atelier d’Amaya (wrong reference, size, default …) L’Atelier d’Amaya commit to refund the delivery fees and to ship a new product at the company’s expense.
The customer can also ask for an entire refund of products and delivery fees.
With L’Atelier d’Amaya’s agreement, the customer can make a choice between an exchange or a refund. The exchange can be for the same or for a different product. If there is a price difference between two products, the customer will have to pay the difference.

ARTICLE 10: GUARANTEE
L’Atelier d’Amaya guarantees every piece of jewellery for one year. The item is guaranteed against any product defect for one year after the date of purchase. The guarantee is valid for normal use of the product.
Excluded from the guarantee: flaws resulting from an accident or any abusive use (impacts, scratches, exposure to corrosive agents) or the consequences of the acidity of the skin and the general normal use of the item.
However, any faulty item or manufacturing defect duly recorded by our customer service will be repaired or replaced.
For the client to benefit from the guarantee, it is necessary to provide the original invoice of the purchased item.
If the client encounters an issue within the guarantee period, the client should contact the customer service immediately by email [email protected] or phone +33 (0) 5 56 81 57 71 for information about the relevant return policy and how to resolve their problem.
Returned items must be placed in their original packaging, sufficiently protected for postage, with the invoice and sent to: 44-50 Boulevard George V, 33077 Bordeaux Cedex.
It is still possible to repair your piece of jewellery after your guarantee has expired. Once the client accepts our assessment of the item we will proceed to repair and return it as soon as possible. The reparation will start once the client validates the relevant payment.

ARTICLE 11: RESPONSIBILITY
The company L’Atelier d’Amaya cannot be held responsible for events attributable to the client, a third party or in case of force majeure that prevent the realisation of the contract.
Furthermore, information contained on the website may include technical inaccuracies, translation or typography errors for which L’Atelier d’Amaya cannot be held responsible. The company L’Atelier d’Amaya is not responsible for the use of other websites which the client has accessed from www.atelier-amaya.com.
If a condition proves to be illegal or considered as null, this will not cause the invalidity of other conditions.
ARTICLE 12: APPLICABLE LAW
Sales concluded with L’Atelier d’Amaya via the website www.atelier-amaya.com are subject exclusively to French law. In case of litigation, a mutual agreement will be pursued before any lawsuit. If not, any litigation about the contract concerning its validity, its interpretation, its execution, its realisation, or its consequences shall fall under the exclusive jurisdiction of the French courts.
ARTICLE 13: INTELLECTUAL PROPERTY
The company L’Atelier d’Amaya owns the website www.atelier-amaya.com.
All the elements (designs, styles, illustrations, graphics, soundtracks, wording, logos, trademarks, etc.) contained in the www.atelier-amaya.com website are the exclusive property of L'Atelier d'Amaya. It is forbidden to reproduce all or any part thereof by any process whatsoever, or distribute, publish, transmit, modify or sell all or any part of the content of the www.atelier-amaya.com website or to create any material derived therefrom. The "L'Atelier d'Amaya" trademark, the figurative trademark of the cat, all other trademarks and logos associated with L'Atelier d'Amaya, registered or otherwise, displayed on the www.atelier-amaya.com website, as well as the domain name www.atelier-amaya.com, are and shall remain the exclusive property of the company L'Atelier d'Amaya. No reproduction, distribution, transmission, modification or use of these trademarks without the prior express agreement of L'Atelier d'Amaya is permitted on any grounds whatsoever.
ARTICLE 14: PERSONAL DATA
When placing an order or subscribing to the newsletter, the information required on the website www.atelier-amaya.com are: name, address, phone number and client number.
Moreover, some data will be collected when navigating the website www.atelier-amaya.com via cookies.
The personal data will only be used in the frame of activity www.atelier-amaya.com in order to guarantee a better tracking of orders and an improvement of services. The company L’Atelier d’Amaya commits not to share any personal data with third-party organisations without notifying or gaining permission from the client.

ARTICLE 15: CUSTOMS
Every order placed on the website and delivered abroad may be subject to import taxes and duty according to the legislation of the country of delivery. Import taxes and duty are at the client’s own expense. L’Atelier d’Amaya is not responsible for verifying and informing their clients of the customs duties and applicable taxes. The client should inquire with the relevant authorities of the country in question.
ARTICLE 16: LOYALTY PROGRAM
Our loyalty program is completely free! With each purchase on our website, you accumulate points. 1 € = 1 point.
You can transform your points into a voucher when you have reached 200 € of purchase. This voucher is a discount equal to 10% of the amount of your purchases.
Loyalty points are valid for 1 year.
You can find all your points in the "My loyalty points" section of your customer account.
Please note that we operate on two independent systems: your internet loyalty points cannot be combined with your shop loyalty points and vice versa.
Article L211-4 of the Code de la Consommation
The seller is committed to delivering the product in compliance with the contract and for responding appropriately to any defect existing when the goods are received. The seller is also legally responsible for any lack of conformity regarding the packaging, the assembly instructions or the installation of the product when mentioned in the contract or under their responsibility.
Article L211-5 du Code de la Consommation
To be in compliance with the contract, the product must:
• Be appropriate to the use normally expected from similar goods.
• Correspond with the description given by the seller and possess the qualities mentioned by the seller’s sample or model.
• Present the characteristics expected by the customer in view of public declarations made by the seller, the manufacturer or its representative, particularly when advertising or labelling.
• Present the characteristics defined by the agreement between parties OR be appropriate to any special directions issued by the buyer that the seller has agreed to.
Article L211-12 of the Code de la Consommation
The action resulting from a defect in conformity lapses after two years from the date that the product is delivered.
Article L211-16 of the Code de la Consommation
When the buyer asks the seller, within the guarantee period offered to him during the acquisition or the repair of an asset, for a restoration covered by the guarantee, any period of immobilization of more than 7 days will be added to the guarantee period. This period runs from the request of intervention by the buyer.
Article 1641 of the Code Civil
The seller is responsible for any hidden defects or manufacturing faults that make the product unsuitable for use which would have led the client not to buy the item or offer a lower price for it if they had known.
Article 1648-1 du Code Civil
The action resulting from a product defect must be filed by the buyer within 2 years from the discovery of the flaw.
